Training Year 2026
Training Year (TY) 2026 is approaching its close—make sure you complete your required 40 hours of continuing education by June 30. If you fall short, your agency must submit an extension request on your behalf after July 1.
Last year, compliance improved significantly: only about 80 officers were delinquent as of June 30, 2025, and just two failed to meet their extension deadline. Let’s keep that momentum going and reduce TY 2026 delinquencies even further.
KAR 106-2-3 Unprofessional Conduct
There has also been considerable discussion surrounding the recent update to the Unprofessional Conduct KAR, which now includes failure to submit required KSCPOST forms within the 30-day timeframe outlined in KSA 74-5611a. To clarify the intent behind this change, we’ve included the original explanation shared through the Kansas Sheriff’s Association and the Kansas Association of Chiefs of Police. This is being reissued via the Spotlight to ensure all officers understand the purpose of the update and to address any misconceptions.
Our March Spotlight focused on two critical areas: Annual Agency Verifications and the updated definition of Unprofessional Conduct under KAR 106-2-3.
Why Agency Verifications Matter
Each year, KSCPOST sends verification rosters to every law enforcement agency in Kansas. This process is essential for maintaining accurate records as mandated by K.S.A. 74-5611a. Accurate data is vital because:
- Certification Status: A “five-year clock” begins the moment an officer separates from service. If the separation isn’t reported, we cannot accurately track when a certification may lapse.
- Training Requirements: Annual training hours may need to be prorated if an officer is out of law enforcement for several months.
- Data Integrity: Both officers and agencies rely on KSCPOST for a true and accurate account of employment history.
The 30-Day Requirement & KAR 106-2-3
Per K.S.A. 74-5611a(c), agencies must submit Form CR301 (Hires) or Form CR304(b) (Separations) within 30 days. While this timeline has been law since 1995, the Commission recently added failure to comply with this requirement to KAR 106-2-3 (Unprofessional Conduct). This update ensures clarity. Because case law clearly and consistently shows “unprofessional conduct” definitions that are too general are not enforceable, this amendment provides a clear, specific standard that avoids ambiguity and ensures the 30-day reporting requirement is enforceable, when needed.
Compliance & Enforcement
To assist agencies, KSCPOST has and continues to use a tiered notification system:
- Initial Contact: If a form is missing past the 30-day mark, we notify the agency.
- Grace Period: The agency is given an additional 30 days (60 days total from the event) to submit.
- Formal Notice: If the form is still missing after 60 days, a formal letter is sent to the agency head reminding them of their statutory obligation.
Since January 2026, we have issued 112 formal letters to non-compliant agencies. The need for diligence is clear: in one recent case, an agency that had confirmed its roster as “accurate” for seven years in a row finally reported that an officer listed on their roster had actually separated in 2018. This is not an isolated example.
Moving Forward
KSCPOST will maintain its current notification practices. We have no intention of opening cases against agency heads for the occasional late form; we recognize that extenuating circumstances exist and administrative oversights happen. The update to KAR 106-2-3 is specifically designed to address instances of repeated and willful failure to comply with the requirements of the Kansas Law Enforcement Training Act.
